Fanfuse Terms of Use

1. About Fanfuse

Fanfuse is a free football prediction and fantasy-style game. Players select footballers and earn points based on their real-world performances.

Fanfuse is provided for entertainment purposes only.

Fanfuse is not a gambling or betting service. There is currently no entry fee, stake, wager or payment required to participate, and Fanfuse does not currently offer monetary or other prizes of economic value for game results.

Fanfuse does not accept bets or wagers.

We will not introduce paid games, stakes or prizes that could constitute gambling without first assessing the applicable legal and regulatory requirements.

2. Eligibility

You may use Fanfuse if you meet the minimum age requirements applicable to you.

Users under 18 may participate only with the permission and supervision of a parent or legal guardian.

By creating an account, you confirm that:

• the information you provide is accurate;
• you are permitted to use Fanfuse under the laws applicable to you; and
• where you are under 18, you have obtained the required permission from your parent or legal guardian.

We may restrict access where we reasonably believe these requirements have not been met.

3. Your account

You are responsible for maintaining the security of your account and for activity carried out through it.

You must not:

• create or operate accounts for another person without permission;
• share your account credentials;
• create multiple accounts to gain an unfair advantage;
• impersonate another person;
• use automated systems, bots or scripts to participate;
• attempt to interfere with Fanfuse or its scoring systems; or
• use Fanfuse for unlawful purposes.

You must notify us if you believe your account has been accessed without your permission.

4. Fair play

Fanfuse is intended to be a fair game.

Cheating, manipulation, exploitation of technical errors, automated participation, multiple accounts, deliberate abuse of scoring systems or other attempts to obtain an unfair advantage are prohibited.

We may investigate suspected abuse and may, where reasonably necessary:

• remove points or selections;
• amend rankings;
• disqualify a team;
• suspend or terminate an account; or
• restrict access to a league or Fanfuse.

Our decisions concerning the integrity of the game will be made reasonably and proportionately based on the information available to us.

5. Game rules, selections and scoring

The specific rules of each Fanfuse game, including player groups, scoring categories, captain rules, selection deadlines and tie-breakers, will be displayed within the relevant game.

Unless the game rules state otherwise:

• squad selections lock at the published deadline;
• captain selections lock at the published deadline for each round;
• locked selections cannot be changed;
• points are calculated using the applicable real-world football data and scoring rules; and
• captain selections may receive the scoring multiplier specified in the relevant game.

We may correct obvious scoring, data or technical errors and may amend rankings where necessary to maintain the integrity of the game.

Where a match, player, competition or data source is cancelled, postponed, abandoned or materially changed, we may apply reasonable adjustments in accordance with the published game rules.

6. Leagues

Fanfuse may provide global leagues and private leagues.

Global leagues

Global leagues are rankings provided by Fanfuse. Users do not communicate directly with one another through the Fanfuse game.

Your team name, score and ranking may be displayed in relevant league tables. Your chosen manager/display name may be displayed where you have enabled global league participation.

Private leagues

Private leagues may be created and administered by individual users ("League Owners").

League Owners are responsible for managing their private leagues, including inviting members and administering their league within the functionality provided by Fanfuse.

League Owners must not use private leagues for unlawful, abusive, discriminatory, fraudulent or otherwise prohibited activity.

Fanfuse may remove, suspend or close a private league where we reasonably believe that it breaches these Terms, applicable law or the proper operation of Fanfuse.

A League Owner's responsibility does not transfer Fanfuse's legal obligations to them, and nothing in these Terms limits any rights or obligations that cannot legally be excluded.

7. WhatsApp and other external communities

Fanfuse may provide links or invitations to WhatsApp groups or other third-party communities.

These communities are not operated, hosted or controlled by Fanfuse.

Once you leave Fanfuse and enter a third-party service, that service's own terms, privacy policy and rules apply. Fanfuse is not responsible for content, communications, conduct, moderation, availability or activity taking place on third-party services.

We encourage everyone using communities associated with Fanfuse to:

• be respectful;
• enjoy humour and football banter;
• respect different opinions, cultures and backgrounds; and
• know when a joke has crossed a line.

You must not use communities associated with Fanfuse to post or promote unlawful, threatening, harassing, racist, misogynistic, sexist, religiously intolerant, hateful, discriminatory or deliberately abusive content, or content intended to intimidate, threaten or harm another person.

Football banter is welcome. Abuse is not.

Fanfuse does not guarantee that third-party communities will be moderated or that inappropriate content will be removed. Where appropriate, we may remove links or invitations to communities that we reasonably believe are being used in breach of these Terms.

8. User names and content

You may choose a team name and display name.

You must not use names, images or other content that:

• are unlawful or fraudulent;
• impersonate another person or organisation;
• are threatening, hateful, discriminatory or deliberately abusive;
• contain malware or malicious code;
• infringe another person's intellectual property or other rights; or
• are otherwise inappropriate for a football game available to users under 18.

We may change or remove content that breaches these Terms.

You remain responsible for content you submit to Fanfuse.

By submitting content to Fanfuse, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content as reasonably necessary to operate and promote Fanfuse.

9. Personal information

We collect and use personal information necessary to operate Fanfuse.

This may include:

• email address and name;
• display name and global league participation choice;
• eligibility confirmations and records of acceptance of these Terms;
• league membership and squad selections;
• country and location information you provide;
• club information;
• essential session, device, security and error information.

We use this information to:

• provide accounts and leagues;
• calculate scores and rankings;
• maintain game integrity and identify cheating;
• provide technical support;
• maintain security;
• communicate essential operational information; and
• comply with applicable legal obligations.

Your team name, ranking and score may appear in league tables. Your email address will not be publicly displayed.

You can change your display name and, where available, its visibility through your account settings.

Our separate Privacy Policy explains how we process personal information, our legal bases for processing, retention, security measures and your data protection rights.

10. Intellectual property

Fanfuse and its software, design, branding, content, functionality and other materials are owned by or licensed to Fanfuse and are protected by applicable intellectual property laws.

You may use Fanfuse for its intended personal and non-commercial purpose.

You must not copy, reproduce, modify, distribute, reverse engineer, scrape or commercially exploit Fanfuse or its content without our prior written permission, except where permitted by law.

Football club names, player names, images, statistics and other third-party materials may belong to their respective owners. Fanfuse does not claim ownership of third-party intellectual property.

11. Availability and changes

We aim to keep Fanfuse available and accurate, but we do not guarantee that the service will always be available, uninterrupted or error-free.

We may:

• modify or improve Fanfuse;
• change game rules;
• suspend particular games or leagues;
• temporarily suspend the service for maintenance or security reasons; or
• discontinue Fanfuse or particular features.

Where reasonably possible, we will provide notice of significant changes.

We may update these Terms from time to time. Where a change is material, we will provide reasonable notice before it takes effect where required by law.

Your continued use of Fanfuse after the updated Terms take effect constitutes acceptance of the updated Terms.

12. Suspension and termination

You may stop using Fanfuse at any time.

We may suspend or terminate your access where we reasonably believe that you:

• have breached these Terms;
• have attempted to cheat or manipulate the game;
• have used Fanfuse unlawfully;
• have endangered the security or operation of Fanfuse; or
• have engaged in abusive or harmful conduct.

Where appropriate and legally required, we will provide information about the reason for suspension or termination and any available means of appeal.

Termination does not affect provisions that are intended to continue after termination.

13. Liability

We provide Fanfuse with reasonable care and skill.

To the maximum extent permitted by applicable law, Fanfuse is not responsible for:

• interruptions or failures caused by events outside our reasonable control;
• failures of third-party services, including football data providers, hosting providers or WhatsApp;
• content or conduct of other users on third-party services;
• loss caused by unauthorised access resulting from your failure to protect your account; or
• indirect or consequential loss arising from your use of Fanfuse.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion or limitation would be unlawful.

If you are a consumer, nothing in these Terms affects any mandatory rights or protections you have under the law applicable to you.

14. Third-party services

Fanfuse may contain links to third-party websites, applications or services.

We do not control and are not responsible for third-party services, their content, availability, security, privacy practices or terms.

Your use of third-party services is at your own risk and subject to their applicable terms.

15. Applicable law

These Terms are governed by the laws of [DENMARK / United Kingdom / Malta], except where mandatory consumer protection laws in your country of residence provide otherwise.

Any dispute will be subject to the courts of Denmark, United Kingdom or Malta, except where applicable law gives you the right to bring proceedings elsewhere.
